Privacy Policy

MoodMonkey helps organizations listen to their people without watching over their shoulders. That only works if we hold ourselves to the same standard, so this policy describes plainly what personal data we handle, why, and what rights you have.
1. Who We Are

For this website and our own business operations (such as contact requests and newsletters) we are the controller. For the wellbeing data that employees submit in the MoodMonkey product, our customer (the employer) is the controller and we act as processor under a Data Processing Agreement.
2. Data We Collect on This Website
- Analytics: we use privacy-friendly, cookieless analytics. We see aggregated statistics such as page views, referrers and country, but no personal profiles. No tracking cookies are placed, which is why this site shows no cookie banner.
- Contact and demo requests: when you submit a form or book a call, we receive the details you provide, such as your name, work email address, organization and message. We use these only to respond to your request.
- Newsletter: if you subscribe, we store your email address to send you the newsletter. Every email contains an unsubscribe link.
3. Data We Process in the Service
When your employer uses MoodMonkey, we process on their behalf:
- Account data of users with dashboard access, such as name, work email address and role.
- Check-in data: the daily mood responses and optional comments. The Service is designed for data minimization: check-ins require no personal identifiers beyond what is needed to make the insights work, and results are presented at team and organization level.
For this data your employer is the controller. Questions or requests about it can be addressed to your employer, and we assist them in answering you.
4. Purposes and Legal Bases
We process personal data to provide and improve the Service and website (performance of a contract and legitimate interest), to respond to requests you send us (legitimate interest or pre-contractual steps), to send newsletters (consent, which you can withdraw at any time), and to comply with legal obligations such as tax record keeping.
5. Where Your Data Is Stored
All personal data is stored within the European Union. We do not transfer personal data outside the European Economic Area unless a recipient provides appropriate safeguards in line with the GDPR, such as the EU Standard Contractual Clauses.
6. Sharing and Processors
We never sell personal data. We share data only with service providers who help us run MoodMonkey, such as EU-based hosting providers and an email delivery provider, and only under processing agreements. The current list of sub-processors for the Service is described in our Data Processing Agreement and is available on request.
7. Retention
We keep personal data no longer than necessary: contact requests up to 12 months after the last contact, newsletter data until you unsubscribe, financial records for the legally required 7 years, and Customer Data in the Service for as long as the customer's subscription runs plus a 30-day export window after termination.
8. Your Rights Under the GDPR
You have the right to access, rectify and erase your personal data, to restrict or object to processing, and to data portability. Where processing is based on consent, you can withdraw that consent at any time. Email [email protected] and we will respond within one month. You also have the right to lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens) via autoriteitpersoonsgegevens.nl.
If your request concerns wellbeing data processed for your employer, we will refer it to your employer as controller and support them in handling it.
9. Security
We protect personal data with technical and organizational measures appropriate to the risk, including encryption in transit, access controls on a need-to-know basis, EU hosting and regular backups. No system is perfectly secure, but we design for privacy first: the less personal data we hold, the less can go wrong.
10. Changes to This Policy
We may update this policy from time to time, for example when the Service or legislation changes. The date at the top shows the latest revision. For material changes we will inform customers and, where appropriate, website visitors.
